The measurable benefit was small before the restriction
Mortgage trigger leads let credit-reporting companies sell an applicant’s contact and credit information to competing lenders and brokers. GAO’s analysis of the 2022–2024 National Survey of Mortgage Originations suggests no more than 3.5% of homebuyers obtained a loan through competing offers based on those leads.
That estimate does not prove the offers never helped other borrowers negotiate or compare prices. It does put an upper bound on the share that reported using one of the competing offers for the eventual loan.
The Homebuyers Privacy Protection Act restricted sales beginning in March 2026 to parties with an existing relationship or the consumer’s consent. GAO said too little time has passed to measure the law’s effect.

Privacy benefit and market benefit must be measured separately
Consumer advocates and industry participants told GAO that the volume could overwhelm or confuse applicants and expose them to misleading practices. Industry participants also argued that competing offers can encourage comparison shopping.
The audit did not recommend eliminating comparison shopping. It noted that consumers can compare lenders through online tools and referrals before or after applying.
The original contribution here is the scale comparison: a broad information-sale mechanism was defended as a shopping tool, while the best reported federal survey estimate tied actual loan selection to no more than 3.5% of borrowers. Future complaint volume, consent rates and borrowing costs are the proper post-law tests.
