The completeness failure was nearly universal

The Government Accountability Office reviewed 37 State Department congressional notifications for fiscal 2023 and 2024 funding that used legal authorities allowing assistance otherwise restricted by law. GAO found 36 did not address one of three reporting criteria in the appropriations acts or accompanying congressional explanations.

That is 97.30% of the reviewed notices. GAO traced the pattern to departmental drafting guidance that did not cover all three criteria, making the weakness systemic in the reviewed process rather than an isolated typo.

A second sample exposed an identification problem

GAO separately examined 101 notifications citing the democracy-assistance exemption for fiscal 2021 through 2024. Most did not clearly connect the legal authority to the specific programs or activities for which it would be used.

The report does not say all 101 notices were unlawful or that the underlying programs were improper. It says the notices often failed to give Congress a clear audit trail between an exemption and the activity financed under it.

State disagreed, leaving the recommendations open

GAO recommended updated guidance that incorporates annual reporting criteria and requires notices to identify specific programs and activities when known. The State Department disagreed with both recommendations; GAO maintained that the changes would improve oversight.

Disagreement is relevant counterevidence: it means the watchdog’s proposed remedy was not accepted as necessary by the agency. Both recommendations remained open in the public record when this analysis was prepared.

Method and limits

What’s the Scoop With Broach calculated the 97.30% share from GAO’s 36-of-37 finding and kept the 101-notice result in GAO’s own qualitative “most” formulation because the summary does not publish an exact affected count.

The newsroom did not inspect classified annexes or infer program outcomes from notice quality. The original contribution is the cross-sample accountability comparison, not a claim that every exempted assistance program failed.
